This Rental Agreement (“Agreement”) is entered into by and between Bnbmanager Curacao NV (“Company”) and the individual guest (“Guest”) whose name and signature are stated in this agreement between both parties. Terms not specified in this agreement shall be per the House rules or the Reservation policies provided separately by the company.
The parties agree as follows:
1. BOOKING AND CONFIRMATION
1.1. To reserve a room, the guest must provide their name, address, arrival and departure time, and payment method. A reservation is binding upon verbal or written confirmation from the company and receipt of a reservation confirmation number. To secure the reservation, the company may apply different rules, such as reservation fees or credit card guarantees.
1.2. The Company reserves the right to apply special terms and conditions that differ from those stated in this agreement in case of public holidays, special events, seasonality, or additional services required.
1.3. Only a person over 18 is allowed to make a reservation. The adult making a reservation for a person under 18 will be held responsible for the minor.
2. ARRIVAL AND DEPARTURE
2.1. The apartment shall be available for guests from 3:00 pm on the day of arrival and shall be vacated by 11:00 am on the day of departure. The company may agree to make exceptions to check-in and check-out times. The company reserves the right to confirm this.
2.2. Only checked-in guests shall be allowed on private premises, and the guest cannot exceed the maximum capacity per accommodation. The number of guests needs to be communicated and confirmed by the accommodation before check-in.
2.3. The apartment shall be reserved for the guest until 8:00 pm on arrival unless otherwise agreed upon. In case of arrival after 8:00 pm, the guest may guarantee the reservation with a credit card or other specified method. Otherwise, the company may release the reserved room for sale after 8:00 pm.
2.4. If the reserved apartment is unavailable upon the guest’s arrival, the company shall arrange an equivalent apartment at no extra charge.
3. ADDITIONAL HOUSE RULES
A. At most 5 adults are permitted to stay overnight in the apartment.
B. A maximum of 8 guests are allowed on the patio or in the pool area unless prior approval is obtained from a Board member.
C. Glass is not allowed in the pool area. If an occupant of the unit breaks glass in the pool area, the rental guest agrees to pay the Reef HOA $3,000 USD for damages.
D. Jumping from the upper pool is strictly prohibited.
E. No speaker systems are allowed at the pool.
F. No bouncing or kicking of balls is permitted on the property.
G. Drug use on the property is strictly prohibited.
H. A minimum stay of 3 nights is required for all rentals.
I. Unreasonable noise will not be tolerated, especially after quiet hours.
J. Harassment policy: No guest or individual on the property of The Reef shall engage in any of the following:
Screaming or loud yelling.
Derogatory comments, jokes, or slurs based on sex, marital status, race, color, religion, ethnic or national origin, ancestry, age, physical or mental disability, or sexual orientation.
Displaying offensive pictures or emails.
Unwelcome physical contact such as touching or grabbing.
Spreading malicious gossip or rumors.
Suggestive gestures or sexual comments or behavior.
Note: Any form of harassment or discrimination is strictly prohibited. Any incidents should be reported confidentially to Blue Bay security.
Eviction Policy: If any rental guest is evicted due to violations of these rules, they agree to forfeit any monies paid. There will be no refunds, and the guest is still responsible for any outstanding balances owed.
4. FORCE MAJEURE
The company shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, war, terrorism, riots, civil unrest, natural disasters, or any other unforeseeable events.
5. GUARANTEED RESERVATION
5.1. Credit card guarantees are required for all bookings. The company will provide a secure payment link to guarantee the booking. The company will not ask for credit card details via email or phone.
5.2. The company reserves the right to request partial or full prepayment for certain reservations.
6. PAYMENTS
6.1. Payment methods accepted include common credit/debit cards. The company operates a no-cash policy and will not accept foreign currency, vouchers, or checks unless otherwise agreed.
6.2. All reservations must be prepaid, or payment must be secured by credit card upon arrival.
7. DEPOSIT
7.1. The company requires every guest to provide a $300 deposit to cover possible damages to the property, excessive utility usage, or missing inventory. This deposit is a credit card authorisation, meaning the amount is reserved but not immediately collected by the company. In a dispute, the company reserves the right to withhold the deposit.
7.2. The deposit must be completed via credit card authorisation before check-in. If guests do not have the option to provide a deposit via credit card, the deposit can be made via bank transfer or in cash at $300.
7.3. After check-out, the deposit via credit card will be released automatically by the bank after approximately 15 working days, unless there is damage or excessive usage of water and/or electricity. If such a situation arises, we will communicate this with the guest. Please note that the company has no control over the exact date of the release of the deposit, as this depends on the guest’s bank. Any deductions due to repairs or additional charges for excessive usage will be communicated to the guest before processing. Please notice that we are not responsible for difference by foreign exchange currency or deduction made by the bank when we refund the deposit made via bank transfer.
8. CANCELLATION AND NO ARRIVAL
8.1. Cancellations made up to 48 hours before arrival are free of charge.
8.2. No-shows without prior cancellation may be charged the full stay amount.
9. EARLY DEPARTURE
Guests leaving before their scheduled departure date may be charged for the full reservation period.
10. UTILITY USAGE
10.1. A “Fair Usage Policy” for electricity is in place, with limits based on the number of bedrooms used. All two-bedroom apartments at The Reef use a total of 40Kwh per day. Exceeding these limits will incur additional charges of 0.40 USD per kWh, based on the market price in Curacao.
11. GUEST BEHAVIOR
Guests are expected to follow good manners and follow the company’s rules. Violations may result in removal from the premises without a refund.
